A RADICAL CHANGE TO FIGHTING CORRUPTION IN KENYA

Kenya has just finished its 2022 elections. The promise of change leads us to write the following.
Any past attempts in the economic sector to elevate Kenya into middle income nation status have floundered on the dire state of the country’s famed corruption. In fact, corruption is such a drain on its economic life presently that no sane investor will – under the current scenario – set up multi million dollar projects in Kenya unless the GOK is a partner thereto. That is anathema to many investors weaned on the Chicago School & Friedman Milton’s economic theories, and thus Kenya has achieved pariah status due to its inability to conquer the corruption dragon.
Much ink has been wasted on thirty years of active failure in making a difference in corruption statistics in Kenya. We have a more radical solution, whose sine qua non is the direct and active participation of the Office of the Presidency (‘OTP’). H.E. The President Dr. Ruto has recently personally taken responsibility for fighting corruption and the resultant loss of resources in Kenya, stating “No one will be allowed to steal the republic’s resources…you try and you will encounter me personally … action will declare my intentions louder.”
The main institutions in Kenya that have the constitutional mandate to protect citizens’ life and property are the (i) Judiciary, (ii) Police and (iii) Directorate of Public Prosecution (“DPP”). Without wanting to place lipstick on a pig, let us bluntly state that all three have and are continuing and shall continue to violate that constitutional trust in unimaginable ways. Bribed judges, bribed police and bribed prosecutors. What a disaster. Anyone denying this either is not engaged in service delivery in these sectors, or lives with fairies...

Criminal Law

Workplace Investigations


Every employer is responsible for making sure that every person who is involved with the workplace – in any way – feels safe and respected in the work environment. A workplace investigation is conducted when there has been a complaint made by any person against an employee or volunteer of a workplace – including a supervisor or person in management – about some action or conduct by that employee/volunteer/manager, in a situation that involves the workplace or work environment, even if the action or conduct did not occur while the employee (or volunteer or manager) was performing their job duties.
A workplace investigator interviews everyone involved in the situation – which may have occurred in one incident or in several incidents over a period of time – to gather information from each person’s perspective, with a view to determining what actually occurred. In addition to finding out what happened, the workplace investigator also considers what conditions of the work environment may have contributed in some way to what happened. Based on all of the information gathered, the workplace investigator determines whether it is more likely than not that the employee/volunteer/manager engaged in some type of misconduct or wrongdoing. (While this may include potential criminal wrongdoing in some cases, the purpose of a workplace investigation is not to decide whether the employee/volunteer/manager committed any criminal offence.)

What Are Your Business Hours?

We offer flexible meeting times and schedule calls to accommodate clients that require assistance outside of the usual 9:00am – 5:00pm office hours structure.

How Do You Bill For Your Legal Services?

We are transparent and provide a comprehensive breakdown of our charges using our legal software. You will be able to see the time spent on tasks and a description of what work was done during that time. Hourly fees range from 50 to 300 USD per hour, depending on which professional is assigned and their expertise in the field.

Do You Charge For Initial Consultation?

We do not. Please set up an appointment through our website Inquiry Form or give us a call so we can discuss your matter and determine how we can help. In most cases, before we begin to act for you, we will require a retainer (a monetary deposit for legal fees and expenses), which will be explained and discussed in the initial consultation.

What Should I Bring To Our First Consultation?

Please come with any documents that are relevant to your case (correspondence, certificates and licences, receipts, contracts, pictures, reports, official documentation…), a list of questions you may have, and preferably copies of the documents that you can leave with us. If you are unsure what may be relevant, kindly call us so that we can provide a specific list for you based on your case.

How Long Do I Have To File A Lawsuit?

The statute of limitations varies between countries and the type of claim. Some types of claims have a shorter or longer time limit, and the exact nature of your claim will help us determine the applicable time limit. Kindly use the Inquiry Form to describe the nature of your claim, or contact us as soon as possible to ensure that your claim is filed within the time limit.

How Long Will My Case Take?

The legal process is not always straightforward, and proceedings for each case will be different, but we will keep you informed and ensure that we are prepared for every step along the way. During your initial consultation, we can provide a typical timeline for similar cases, and outline what you can expect in the process.

Will I Have To Go To Court

We have had tremendous success reaching settlements or plea agreements so that we can avoid legal battles in court. Depending on your case, there may be options we can take to achieve the desired outcome outside of a courtroom. Regardless of the route taken, we plan and strategise every case as if we expect a trial so that we are always prepared if necessary.
